Purchase Rules

1. General Provisions
1.1. These Terms and Conditions of sale (hereinafter referred to as the "Terms") are a legally binding document for the Parties, setting out the rights, obligations, and liabilities of the Buyer and the Seller when the Buyer purchases goods from the online store.
1.2. The Seller reserves the right to change, correct, or supplement the Terms at any time, in accordance with the requirements set by legislation. The Buyer is informed via the online store website. The Terms applicable at the time of the order placement are binding on the Buyer when shopping at the online store.
1.3. The following individuals have the right to make purchases at the online store:
1.3.1. Competent natural persons, i.e., individuals who have reached the age of majority and whose legal capacity has not been restricted by a court order;
1.3.2. Minors aged 14 to 18, only with the consent of their parents or guardians, unless they manage their own income;
1.3.3. Legal entities;
1.3.4. Authorized representatives of all the above-mentioned persons.
1.4. By confirming these Terms, the Seller guarantees that, according to paragraph 1.3 of the Terms, the Buyer has the right to purchase goods in the online store.
1.5. The contract between the Buyer and the Seller is considered concluded when the Buyer, having formed a shopping cart in the online store, provided the delivery address, selected the payment method, and reviewed the Seller's Terms, presses the "Confirm Order" button (see section 5 "Ordering goods, prices, payment procedure, deadlines").

2. Personal Data Protection
2.1. The Buyer can order goods in the online store:
2.1.1. by registering in the online store - entering the requested registration data;
2.1.2. without registering in the online store.
2.2. When ordering goods as described in section 2.1, the Buyer must provide the necessary personal data for processing the order: name, surname, delivery address, phone number, and email address.
2.3. By confirming these Terms, the Buyer agrees that their personal data provided in section 2.2 will be processed for the sale of goods and services in the online store, analysis of the Seller's activities, and direct marketing purposes.
2.4. By agreeing to the processing of the Buyer's personal data for the purpose of selling goods and services in the online store, the Buyer also agrees that information necessary to fulfill the order will be sent to the provided email address and phone number.
2.5. The Buyer is responsible for keeping and not disclosing their login data.

3. Buyer's Rights and Obligations
3.1. The Buyer has the right to purchase goods from the online store according to these Terms and other sections of the online store.
3.2. The Buyer has the right to cancel the purchase agreement with the online store by notifying the Seller in writing (via email, specifying the item to be returned and its order number) within 14 (fourteen) working days from the delivery date, except in cases where the law prohibits cancellation (e.g., for hygiene products such as bedding; see the information on the Consumer Centre website).
3.3. The right in section 3.2 can only be used if the product has not been damaged or substantially altered and has not been used.
3.4. The Buyer agrees to accept the ordered goods and pay the agreed price for them.
3.5. If the Buyer's registration details change, they must update them immediately.
3.6. The Buyer agrees not to share their login data with third parties. If the Buyer loses login data, they must immediately notify the Seller using the contact methods provided in the "Contact" section.
3.7. By using the online store, the Buyer agrees to these Terms and undertakes to comply with them and not to violate Lithuanian legal acts.

4. Seller's Rights and Obligations
4.1. The Seller agrees to provide the Buyer with the necessary conditions to use the online store's services properly.
4.2. If the Buyer attempts to harm the stability and security of the Seller's online store or breaches their obligations, the Seller has the right to immediately and without warning restrict or suspend the Buyer's access to the online store or, in exceptional cases, cancel the Buyer's registration.
4.3. The Seller agrees to respect the Buyer's privacy regarding the personal information provided in the online store's registration form.
4.4. The Seller agrees to deliver the goods ordered by the Buyer to the provided address.

5. Ordering Goods, Prices, Payment Procedure, Deadlines
5.1. The Buyer can purchase goods from the online store 24 hours a day, 7 days a week.
5.2. The contract becomes valid when the Buyer clicks the "Confirm Order" button, and after receiving the order, the Seller confirms it by sending a confirmation email to the Buyer's provided email address.
5.3. The prices of goods in the online store and in the order are stated in euros, including VAT.
5.4. The Buyer can pay for the goods using one of the following methods:
5.4.1. Payment via online banking – an advance payment using the Buyer's chosen online banking system. The Buyer must have an online banking agreement with a supported bank. The Buyer transfers money to the online store's account. The bank is responsible for the security of the transaction.
5.4.2. Payment via bank transfer – an advance payment where the Buyer prints the order and visits the nearest bank branch to transfer money to the online store's bank account.
5.5. The Buyer agrees to pay for the goods immediately. The order will only be processed and shipped once payment is received.

6. Delivery of Goods
6.1. The Buyer, when choosing the delivery service, agrees to provide the exact delivery address.
6.2. The Buyer agrees to accept the goods personally. If the Buyer cannot accept the goods personally and they are delivered to the specified address, the Buyer cannot make complaints about delivery to the wrong person.
6.3. Goods are delivered by the Seller or the Seller's authorized representative (courier).
6.4. The Seller will deliver the goods to the Buyer within the delivery deadlines indicated in the product descriptions. These deadlines are approximate and do not apply if the required goods are not available in the Seller's warehouse. The Buyer will be notified about any shortage of the ordered goods. The Seller also agrees that in exceptional cases, delivery may be delayed due to circumstances beyond their control. In such cases, the Seller agrees to contact the Buyer and agree on the conditions of delivery.
6.5. The Seller is not liable for any delivery delays if the delay is due to the fault of the Buyer or circumstances beyond the Seller's control.
6.6. The Buyer must immediately inform the Seller if the package is damaged or if incorrect or incomplete goods are delivered.
6.7. If the Buyer notices damage to the package upon delivery, they must note it on the courier's delivery document or create a separate act of the damage in the presence of the courier. If these actions are not taken, the Seller is released from liability for any product damage related to the packaging. 

7. Product Quality and Warranty
7.1. The details of each product sold in the online store are generally provided in the product description next to each product.
7.2. The Seller is not responsible if the color, shape, or other characteristics of the products in the online store do not match the actual product size, shape, and color due to the Buyer’s display characteristics.
7.3. The Seller provides a quality warranty for certain types of products, with the specific warranty period and other conditions indicated in the product descriptions.
7.4. If no quality warranty is provided by the Seller for certain products, the legal warranty provided by relevant legislation applies.

8. Product Returns and Exchanges
8.1. Defective products will be repaired, and faulty products will be exchanged or returned in accordance with the Rules for Return and Exchange of Goods approved by the Lithuanian Minister of Economy (Order No. 217, June 29, 2001), except in cases where the contract cannot be canceled according to Lithuanian law (e.g., for hygiene products such as bedding; see the information on the Consumer Centre website). Money for returned products will always be transferred only to the payer's bank account.
8.2. To return a product based on section 8.1, the Buyer may do so within 14 (fourteen) working days from the delivery date by notifying the Seller using the contact methods provided in the "Contact" section, specifying the product to be returned, its order number, and the reason for the return.
8.3. When returning products, the Buyer must follow these conditions:
8.3.1. The returned product must be in its original packaging.
8.3.2. The product must be undamaged by the Buyer.
8.3.3. The product must not be used and retain its commercial appearance (no damage to labels, no removed protective film, etc.) (this condition does not apply when returning a defective product).
8.3.4. The returned product must be in the same set as when the Buyer received it.
8.3.5. The purchase document for the returned product must be provided.
8.4. The Seller has the right not to accept products returned by the Buyer if the Buyer does not comply with the return procedure established in section 8.3.
8.5. In case of returning an incorrect or faulty product, the Seller commits to accept such products and replace them with appropriate items.
8.6. If the Seller does not have suitable replacement products, the Buyer will be refunded the amount paid, excluding delivery charges.

9. Buyer’s and Seller’s Liability
9.1. The Buyer is fully responsible for the accuracy of the personal data they provide. If the Buyer does not provide accurate data in the registration form, the Seller is not liable for any resulting consequences and has the right to claim compensation for any direct damages incurred.
9.2. The Buyer is responsible for actions performed while using this online store.
9.3. The Buyer who has registered is responsible for transferring their login data to third parties. If a third party uses the online store services by logging in with the Buyer's data, the Seller will consider that person the Buyer.
9.4. The Seller is released from any liability if the Buyer fails to familiarize themselves with these Terms, despite being given the opportunity, and disregards the Seller's recommendations and the Buyer's obligations.
9.5. If the online store contains links to other companies’, institutions’, organizations’, or individuals' websites, the Seller is not responsible for the information or activities on those sites, does not monitor them, and does not represent those companies or individuals.
9.6. In case of damages, the responsible Party must compensate the other Party for direct losses.

10. Marketing and Information
10.1. The Seller may, at their discretion, initiate various promotions in the online store.
10.2. The Seller has the right to unilaterally change the terms of promotions, as well as to cancel them, without separate notice. Any changes or cancellations of the promotion terms will only apply to future transactions, starting from the moment of the change.
10.3. The Seller sends all notifications to the contact details provided by the Buyer in the registration form.
10.4. The Buyer sends all notifications and inquiries to the Seller using the contact details provided in the "Contact" section of the online store.
10.5. The Seller is not responsible if the Buyer does not receive informational or confirmation notifications due to internet connection issues or email service provider network failures.

11. Use of Content
11.1. All content of elsprendimai.eu (product descriptions, product selection guides, diagrams, photos, compatibility tables and configurator results) belongs to UAB „Elektrotechnikos sprendimai“ and is protected by copyright and the database maker’s rights.
11.2. Copying the content, republishing it for commercial purposes, systematically extracting it by automated means or using it to train artificial intelligence models without the Seller’s written consent is prohibited. Short quotations are permitted with an active link to the source.

12. Final Provisions
12.1. These Terms and Conditions of Sale are drawn up in accordance with Lithuanian laws and regulations.
12.2. Any disputes arising from the implementation of these Terms will be resolved through negotiations. If an agreement cannot be reached, disputes will be resolved in accordance with the procedures established by Lithuanian law.
